Terms of Service

1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Smoke & Strings Records ("we," "us," or "our"), concerning your access to and use of our music production services, studio facilities, and website.

2. Services Overview

Smoke & Strings Records provides professional music production services including but not limited to:

Core Services

• Music recording and production
• Audio mixing and mastering
• Sound design and audio post-production
• Music consultation and arrangement
• Vocal tuning and editing
• Studio equipment rental (when available)

Service Limitations

We reserve the right to:

• Refuse service to anyone for any reason at any time
• Modify or discontinue any service without notice
• Limit the quantities of any services we offer
• Modify pricing for our services at any time

3. Booking & Sessions

Booking Procedure

All studio sessions must be booked in advance through our official channels:

1. Contact us via email, phone, or website form
2. Receive a customized quote and proposal
3. Confirm booking with a deposit (typically 50%)
4. Receive booking confirmation and schedule

Session Time Management

Session time begins at the scheduled start time, not upon your arrival. Late arrivals will not receive time extensions. Overtime may be available at additional cost if the studio schedule permits.

4. Payments & Pricing

Payment Terms

• Deposit: 50% deposit required to confirm booking
• Balance: Remaining balance due upon project completion
• Payment Methods: UPI, bank transfer, credit/debit cards, cash
• Late Payments: 2% monthly interest on overdue balances

Pricing Structure

Our pricing is based on:

1. Hourly Rate: For studio recording time
2. Project Rate: For complete production packages
3. À La Carte: Individual services (mixing, mastering, etc.)
4. Rush Fees: Additional charges for expedited services

5. Intellectual Property

Client Rights

You retain all rights to your original musical compositions, lyrics, and performances. Upon full payment, you receive:

• Master recording rights to the final produced track
• Permission to commercially distribute the music
• Source files and stems (as per package agreement)

Studio Rights

We retain the right to:

• Use your final tracks in our portfolio for promotional purposes
• Credit ourselves as producers/engineers on released tracks
• Use anonymized audio samples for demonstration purposes

6. Project Deliverables

Delivery Formats

Standard deliverables include (varies by package):

• Final mixed and mastered WAV file (24-bit, 44.1kHz or higher)
• MP3 version for online distribution
• Stems (individual track exports) as agreed
• Project files (DAW session) may be provided at extra cost

Delivery Timeline

Typical delivery times:

1. Mixing: 7-10 business days after receiving all materials
2. Mastering: 3-5 business days after mix approval
3. Full production: 14-21 business days from project start
4. Rush services available at 50% additional cost

Revisions

Revision policy:

• Essential Package: 2 rounds of revisions included
• Professional Package: 5 rounds of revisions included
• Studio Package: Unlimited revisions
• Additional revisions: ₹1,999 per round

7. Cancellation & Refunds

Cancellation Policy

• 48+ hours notice: Full deposit refund or reschedule
• 24-48 hours notice: 50% deposit refund
• Less than 24 hours: No refund, deposit forfeited
• No-show: Full session charge, deposit forfeited

Refund Policy

Refunds are only provided under the following circumstances:

1. We are unable to provide the booked service
2. Significant technical failure on our part
3. Cancellation by us for any reason

8. Liability & Warranty

Limited Warranty

We warrant that our services will be performed with reasonable skill and care. However, we do not guarantee:

• Commercial success of your music
• Placement on streaming platforms or charts
• Specific technical results beyond professional standards

Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising from our services shall not exceed the total amount paid by you for those specific services.

9. Client Conduct

Expected Behavior

Clients and their guests must:

• Respect studio staff and property
• Follow all studio rules and safety guidelines
• Provide complete and accurate information
• Make timely payments as agreed

Prohibited Actions

The following will result in immediate termination of services without refund:

1. Harassment or abuse of staff
2. Damage to studio property
3. Illegal activities on premises
4. Recording of explicit content without prior disclosure

10. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon Termination

• All outstanding payments become immediately due
• You must cease use of our services
• We may retain your materials until all payments are received
• Intellectual property rights revert as per payment status

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through:

1. Good faith negotiation between parties
2. Mediation in New Delhi, India
3. Legal proceedings in courts of New Delhi, India

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect.
